Terms of Use of the climbAlot application (effective date: 01.12.2025) define the rules of use, user obligations and the responsibility of the WSPINKA Foundation.
1. General Provisions
- The Terms describe the conditions for using the climbAlot mobile application available on Google Play and App Store.
- The Application belongs to the Climbing Development Support Foundation "Wspinka" (ul. Wincentego Pola 66a, 33-300 Nowy Sącz, KRS: 0000331588, NIP: 7343380796).
- Installing the application means acceptance of the Terms and commitment to comply with them.
- Persons under 16 years of age use the application only with the consent and under the supervision of parents or legal guardians.
2. Scope of Services
- Climbing guide with database of rocks, walls, routes and climbing areas.
- Filtering and searching objects by location, difficulty, type and distance.
- Planning driving and approach routes (map integration) and viewing weather conditions (IMGW).
- Creating an account, user profile, saving favorite objects and planning activities.
- Community features, achievement analysis, project support through online donations.
- Guest mode (basic functionality) or full after registration.
3. Registration and User Account
- Registration requires data (first name, last name, e-mail, password) or external login (Google, Facebook, Apple).
- The user provides true data and secures account access.
- The user is responsible for actions taken using the account.
- The account may be deleted at the user's request or in case of Terms violation.
- You can delete an account by sending a request to kontakt@climbalot.com.
4. Rules of Use
- Using the application in accordance with the law, Terms and good practices.
- The application uses services and data provided by external entities (OpenStreetMap, IMGW, Google, Apple, Facebook) — their terms apply.
- Publishing content inconsistent with the law, using the application for unauthorized purposes and disrupting operation is prohibited.
- The application serves an informational role; climbing remains a high-risk sport, and the creators do not bear responsibility for damages resulting from its use during qualified tourism.
5. Payments and Donations
- Using the application is free.
- The user can provide financial support (BLIK, Apple Pay, Google Pay).
- Payment handling is conducted by external operators, e.g. Tpay.
6. Intellectual Property
- All content, graphics and code are the property of the WSPINKA Foundation or are used under license.
- The user does not acquire copyrights or licenses beyond ordinary use of the application.
- Materials published by the user are transferred to the Foundation for promotional and non-commercial purposes.
7. Liability
- App creators do not guarantee full availability or uninterrupted operation.
- The user uses the tool at their own risk.
- Weather and map data come from external sources and may be incomplete or outdated.
- Information is for orientation; the Foundation is not responsible for decisions made on its basis.
8. Privacy and Personal Data
- Principles of data processing are contained in the Privacy Policy.
- Installing and using the application is simultaneous consent to data processing in accordance with the described policy.
9. Final Provisions
- The Terms are available in the application and on climbalot.com.
- Any questions should be directed to kontakt@climbalot.com.
- The Foundation reserves the right to change the Terms; users will be informed in advance.
- Matters not regulated are governed by Polish law; disputes are resolved by the court competent for the Foundation's registered office.
